HEMA Ireland Insurance waiver

Statements of Understanding:

  1. A person applying for membership agrees to abide by, follow and observe all HEMA Ireland regulations, rules, and codes of conduct.
  2. A person applying for membership agrees to abide by, follow and observe all HEMA Ireland Health and Safety documents, statements, and instructions to ensure safe conduct of HEMA activities.
  3. A person applying for membership agrees to abide by, follow and observe all HEMA Ireland Referee / Umpire instructions and directions to ensure safe conduct of HEMA activities.
  4. A person applying for membership agrees to abide by, follow and observe all HEMA Ireland Instructor directions to ensure safe conduct of HEMA activities.
  5. A person applying for membership agrees not to engage in reckless behaviour during HEMA activities that could put others and themselves at risk.
  6. A person applying for membership agrees to abide by, observe and follow all safety instructions regarding the use of weapons in training, competition, and tournament and to protect the safety of the public.

In consideration of the right to be a member of HEMA Ireland I agree to be bound by the rules, regulations, and codes of conduct of HEMA Ireland.

Membership is only good in the year in which the membership fee has been received by HEMA Ireland and it is an annually renewable membership with no automatic right of renewal.  Membership runs from January to December and there is an annual fee to be paid to HEMA Ireland. 

HEMA Ireland takes the protection of data that we hold about you as a member seriously and will do everything possible to ensure that data collected, stored, processed, maintained, cleansed, and retained is in accordance with data protection legislation.

HEMA Ireland collects your data for the purposes of Membership and Waiver Agreement only. Information relating to your Membership is held for the calendar year and is cleared down at the end of each year. A new membership application form must be completed for the following calendar year. Information relating to signed Waivers is retained for 3 years. We do not share data with any other third party. PERSONAL INJURY WAIVER FORM SECTION

Statements of Understanding and Agreement of Participant:

  1. This waiver form is used to give adequate warning that as with any sport there are dangers and risk of injury when participating in any sport.
  2. A person agreeing to participate in HEMA is considered to have consented to the natural level of risk of injury when partaking in that sport and abides by the principal of law called ‘violenti non fit injuria’.
  3. A person agreeing to participate in HEMA is fully aware of all the risks both in nature and extent that are involved and understands that injuries arising out of the general physicality of contact / active sports and / or from genuine errors in their own judgement or that of other participants is undertaken at their own risk by the act of participating. 
  4. There is no legal requirement on HEMA Ireland to provide Personal Accident insurance cover for Participants/Members.
  5. It is recommended that a person undertaking a sport should obtain whatever additional personal insurances that they feel are appropriate for themselves and the responsibility for this lies solely with the individual person themselves.
  6. A person agreeing to partake in HEMA Ireland and her organised clubs sporting activities through membership becomes a part of HEMA Ireland and therefore there is no legal distinction between that Member and HEMA Ireland and her organised clubs.
  7. HEMA Ireland and directors, officers, volunteers, representatives, and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of HEMA Ireland.
  8. HEMA Ireland declaims all responsibility for negligence and this waiver releases HEMA Ireland from negligence from the fullest extent permitted by law.
  9. The participant agrees that they have no known or knowable physical or mental condition that precludes them from participating in the activities.
  10. The participant agrees that they are in proper physical condition to safely participate.
  11. The participant is not participating against medical advice.
  12. The participant agrees that they have no conditions that their participation would create a risk of danger to themselves or to others.
  13. The participant understands and acknowledges the dangers associated with consumption of alcohol, drugs and mind-altering substances before or during HEMA Ireland activities. The participant agrees not to consume these substances and accepts full responsibility for injury, loss or damage associated with any such consumption.
  14. These statements of understanding bind the heirs, administrators, executors, personal representatives, dependents (if any) and successors of the participant and inures for the benefit of HEMA Ireland.
  15. To the extent permitted by applicable law the participant agrees that these statements of understanding may be pleaded as a bar to any action, suit or proceedings taken at any time by the participate against HEMA Ireland arising out of or as a consequence of particpation in HEMA Ireland activities or any incidental activity.

In consideration of the risk of injury while participating in Historical European Martial Arts, and in consideration for the right to participate in the Historical European Martial Arts training, sporting and competitive activities with HEMA Ireland and her organised clubs I hereby understand and knowingly and voluntarily enter into this waiver and release of liability and acknowledge that I am voluntarily participating at my own risk and that as a member of HEMA Ireland that by this statement and implicit by my participation in HEMA activities that I waive any claim for personal injury or liability against HEMA Ireland, her officers and her organised clubs and discharge HEMA Ireland, her officers and her organised clubs from any and all legal action and claims in pursuit thereof.
